இதைப் பற்றி கேட்கும்போது தரப்பட்ட ஃபத்வாக்கள் இணையத்தில் உள்ளன. அதிலொன்று இவ்வாறு சொல்கிறது: “However, it seems that intercourse with slaves was probably considered a method of contraceptive sexual enjoyment through coitus interruptus (`azl), since the slave owner could practice `azl without prior permission from his slave mate while he could not do so with his free wife without prior permission from her. And if the contraception intended by this `azl failed and the slave woman still bore a child from her master, her child was automatically freed and obtained a son or daughter’s rights including inheritance. In addition, the mother herself could no longer be sold and was freed upon the owner’s death……..the word concubine literally means bed-mate and applies to any female slave that shares the bed of her master. The man is liable to support any child of his and whatever need of its mother that is related to that liability. He is not obliged to marry her but is definitely held to the responsibilities of a father including inheritability whether the mother is a Muslim or not, her child being Muslim. Nor is she entitled to any inheritance unless he decides to marry her AND she is Muslim. Allah knows best.”

“Praise be to Allaah.

The Prophet (peace and blessings of Allaah be upon him) DID NOT MARRY MARIYAH AL-QIBTIYYAH, RATHER SHE WAS A CONCUBINE who was given to him by al-Muqawqis, the ruler of Egypt. That took place after the treaty of al-Hudaybiyah. Mariyah al-Qibtiyyah was a Christian, then she became Muslim (may Allaah be pleased with her).

Ibn Sa’d said:

The Messenger of Allaah (peace and blessings of Allaah be upon him) lodged her – meaning Mariyah al-Qibtiyyah and her sister – with Umm Sulaym bint Milhaan, and the Messenger of Allaah (S) entered upon them and told them about Islam. He took Mariyah AS A CONCUBINE and moved her to some property of his in al-‘Awaali… and she became a good Muslim.”

(2) குரானில் தொடர்ந்து பல வசனங்கள் தமது அடிமைகள்/வேலைக்காரப் பெண்களுடன் முஸ்லீம்கள் உடலுறவு கொள்ளலாம் என்று அனுமதி வழங்குகின்றன. உதாரணமாக,

குரான் வசனம் 033.050
“O Prophet! We have made lawful to thee thy wives to whom thou hast paid their dowers; and those whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee; and daughters of thy paternal uncles and aunts, and daughters of thy maternal uncles and aunts, who migrated (from Makka) with thee; and any believing woman who dedicates her soul to the Prophet if the Prophet wishes to wed her;- this only for thee, and not for the Believers (at large); We know what We have appointed for them as to their wives and the captives whom their right hands possess;- in order that there should be no difficulty for thee. And Allah is Oft-Forgiving, Most Merciful.”

இது போன்றே பிற குரான் வசனங்கள் 23:5-6, 4:24 சொல்கின்றன.
(3) Sahih Bukhari – Volume 1, Book 1, Number 1:

Narrated ‘Umar bin Al-Khattab:

I heard Allah’s Apostle saying, “The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended. So whoever emigrated for worldly benefits or for a woman to marry, his emigration was for what he emigrated for.”

இப்படி பிடிக்கப்பட்ட பெண்களுடன் உறவு கொள்ளும்போது அவர்கள் மூலம் பிள்ளை பெறாதவாறு பார்த்துக்கொண்டனர் முஹமதின் காலத்தில் அவருடன் இருந்த முஸ்லீம்கள். இந்த நடைமுறையை தமிழ் எழுத்தாளரும், திமுக பிரமுகருமான சல்மாவின் ‘இரண்டாம் ஜாமங்களின் கதை’ நாவலில் காணலாம். அதில் தலித் பெண்ணுடன் உறவு கொள்ளும் முஸ்லீம் ஆண், அவள் பிள்ளை பெறாதவாறு பார்த்துக்கொள்வான். இது சுன்னாஹ்/நபி அனுமதித்த செயல்முறை. அது குறித்த ஹதீஸை இங்கே காணலாம்:

Sahih Bukhari – Volume 7, Book 62, Number 137:
Narrated Abu Said Al-Khudri:
“We got female captives in the war booty and we used to do coitus interruptus with them. So we asked Allah’s Apostle about it and he said, “Do you really do that?” repeating the question thrice, “There is no soul that is destined to exist but will come into existence, till the Day of Resurrection.”

இன்னொரு ஹதீஸ் இதைத் தெளிவாக விளக்குகிறது. யூதர்கள் இப்படி உடலுறவின் போது குடும்பக்கட்டுபாட்டை கடைப்பிடிப்பது குறித்து அது கடவுளுக்கு புறம்பானது, பெண் குழந்தைகளை உயிரோடு புதைப்பதற்கு சமம் என்று கருதினர் (அப்துல் கையூம் குறிப்பிட்ட அந்த தடையை முஹமது விதித்தது யூதர்களை பார்த்துத்தான்). ஆனால், முஹமதுவோ குழந்தை பிறப்பதும் பிறக்காததும் கடவுளின் கையில் இருக்கிறது(அதனால் விருப்பப்படி உடலுறவின் போது முஸ்லீம்கள் அடிமைப்பெண்களிடம் நடந்து கொள்ளலாம்) என்று தெரிவித்தார்.

Sunan Abu Dawud – Book 11, Number 2166:

Narrated AbuSa’id al-Khudri:

A man said: Apostle of Allah, I have a slave-girl and I withdraw the penis from her (while having intercourse), and I dislike that she becomes pregnant. I intend (by intercourse) what the men intend by it. The Jews say that withdrawing the penis (azl) is burying the living girls on a small scale. He (the Prophet) said: The Jews told a lie. If Allah intends to create it, you cannot turn it away.

இன்னொரு ஹதீஸில் தெளிவாகவே, குடும்பப் பெண்களிடம் இப்படி நடந்து கொள்ள முடியாது ஆனால், அடிமைப் பெண்களிடம் நடந்து கொள்ளலாம் என்றும் முஹமது தெரிவிக்கிறார்:

Abu Dawood, 29.29.32.100: “Yahya related to me from Malik from Humayd ibn Qays al-Makki that a man called Dhafif said that Ibn Abbas was asked about coitus interruptus. He called a slave-girl of his and said, ‘Tell them.’ She was embarrassed. He said, ‘It is alright, and I do it myself.’ Malik said, ‘A man does not practise coitus interruptus with a free woman unless she gives her permission. There is no harm in practicing coitus interruptus with a slave-girl without her permission. Someone who has someone else’s slave-girl as a wife does not practice coitus interruptus with her unless her people give him permission.’”

முஸ்லீம்கள் பிரச்சாரங்களின் போது ‘இஸ்லாம் பெண்களையும், குழந்தைகளையும் கொல்வதை தடை செய்கின்றது’ என்று திருப்பித்திருப்பி சொல்வது வழக்கம். ஆனால், சொல்லாமல் விடும் ஒரு விஷயம், பெண்களும் குழந்தைகளும் பொருட்களைப் போல முஸ்லீம்கள் பங்குபோட்டுக் கொள்ளக் கூடிய பொருட்கள்(கனீமா) என்ற அல்லாஹ்வின்/முஹமதுவின் இறையியலை. பொருட்கள் எனவே, அந்தப் பொருட்களைப் பெறுவதற்காக ஜிஹாதில் ஈடுபடுவதும், ஈடுபட்டு வெற்றி பெற்றவுடன் பொருட்களை பங்குபோட்டுக் கொள்வதும் முஹமதுவின் காலத்திலிருந்து வழக்கமாக இருக்கிறது. அப்படியும், ஜிஹாதில் பெண்களையும், குழந்தைகளையும் கொல்லலாம் என்று கூறும் ஹதீஸும் இருக்கிறது.
Sahih Muslim –
Book 019, Number 4321:
It is reported on the authority of Sa’b b. Jaththama that the Prophet of Allah (may peace be upon him), when asked about the women and children of the polytheists being killed during the night raid, said: They are from them.

Book 019, Number 4322:
It is narrated by Sa’b b. Jaththama that he said (to the Holy Prophet): Messenger of Allah, we kill the children of the polytheists during the night raids. He said: They are from them.

Book 019, Number 4323:
Sa’b b. Jaththama has narrated that the Prophet (may peace be upon him) asked: What about the children of polytheists killed by the cavalry during the night raid? He said: They are from them.

இது குறித்த ஒரு மதம் மாறிய (புதிய) முஸ்லீம் ஒருவரின் வெளிப்படையான எண்ணங்களை இங்கே காணலாம்:

“When the class reached the five minute break, I asked the Shaikh, whether it was permitted for a male master to sleep with slave women against their will. He immediately said yes, and he added this was agreed upon by all four Sunni schools – Shafi’i, Hanafi, Maliki and Hanbali. I asked to clarify, so if there was a slave market today, I could go and buy a fourteen year old girl just in order to sleep with her? He said yes, and he added, not only was it permitted, it was also common practice among early Muslims. Ali Ibn Abi Talib, the shaikh said, had children from his slaves. The class was shocked, especially the female students. One female student asked, what if the slave woman did not want to? The sheikh affirmed that this was not relevant. Another female student asked, whether this was still applicable today? The shaikh did not address this question – he did not seem to understand what the student meant by “applicable” – but he added that when agreements against slavery came up the Muslim countries “were the first ones to sign”. The shaikh said sex slavery was perfectly according to the Qur’an. I later checked with a more reform-oriented scholar who assured me that the Qur’an does not permit this kind of abuse of human beings.

ow let me be absolutely clear that this was more than just the words of a crazy fiqh teacher. What our shaikh told us is perfectly in line with the consensus of more than thousand years of Islamic scholarship. Let me spell it out:

t is permitted (halal) according to all traditional schools (madhabs) to have sexual intercourse with slave girls of the age of nine years or above against their will and without marrying them. And when I say according to the traditional schools, I mean it was consensus among the scholars of all classic schools of Islamic law be it Sunni or Shia. It is all over the classic sources of Islamic law where this issue is elaborated to great detail.

ow what the past scholars said is one thing, how modern Muslim scholars deal with it is another. Unfortunately, the question is rarely asked, because most Muslims are unaware of the problems, but if it is asked, traditionally oriented scholars fail to condemn sex slavery. Even some of the most influential contemporary scholars are defending and justifying sex slavery [1].

Ask any of the great scholars living today who adhere to traditionalist Islamic thinking. They will all say you have to put the issue of slavery and sex slavery into historical context, but they will all agree that these are permissible in principle, at best suspended due to the lack of a proper Islamic state. And they will refuse to call it abuse or rape or evil.”
